Getting the night started

Terms & Conditions

Effective date: 31 October 2026
Last updated: 2026-10-31

These terms are a legal agreement between you and Lewin Alfie Greenwood, a sole trader (ABN 42 748 420 018) trading as APP OUT'N'ABOUT ("Out'n'About", "we", "us", "our"), the operator of the Out'n'About mobile application and related services (the "App"). By creating an account or using the App, you agree to these terms. If you don't agree, please don't use the App.

We may update these terms from time to time. If we make a material change we'll let you know in the App or by email, and the "last updated" date above will change. Continuing to use the App after a change means you accept the updated terms.

1. Who we are and what the App does

Out'n'About helps people discover nightlife venues near them, see what's happening tonight, connect with friends, watch short videos ("Reels") posted by venues, and play social games. Venues can create a profile, post events and Reels, and share ticket links. The App is aimed at adults enjoying nightlife in Australia.

2. Eligibility

  • You must be at least 18 years old to use Out'n'About. The App is built around nightlife and licensed venues, and some content relates to alcohol.
  • You must be able to form a binding contract with us and not be barred from using the App under any applicable law.
  • If you use the App on behalf of a venue or business, you confirm you're authorised to bind that business to these terms and the Venue Partner Terms.

By signing up you confirm you meet these requirements. We may ask you to verify your age or identity, and we may suspend accounts we reasonably believe don't meet them.

3. Your account

  • You create an account using email and a password, or a Google or Apple login. When you sign up you're asked to accept these terms and the Privacy Policy; we record when you accepted and which versions you accepted. You're responsible for keeping your login details secure and for everything that happens under your account.
  • The information you give us (such as your name, date of birth and contact details) must be accurate and kept up to date.
  • Tell us promptly if you think someone has accessed your account without permission.
  • You can update your profile, change your password, link or unlink login methods, and manage privacy controls in the App's settings. You can ask us to delete your account (see Data Retention Policy).

4. User responsibilities and acceptable use

When you use Out'n'About, you agree not to:

  • break any law, or use the App to plan, promote or carry out anything illegal;
  • harass, threaten, stalk, impersonate or endanger anyone;
  • post content that is hateful, violent, sexually explicit, misleading, or that you don't have the right to share;
  • misuse location features to track, follow or intimidate another person (see the Location and Compass Policy and Safety Policy);
  • send spam, scams, or unsolicited advertising;
  • attempt to access, scrape, overload, reverse-engineer, or interfere with the App, its servers, or other users' accounts;
  • create fake accounts, fake venues, or fake events, or manipulate likes or other engagement.

Our Community Guidelines explain acceptable behaviour in more detail and form part of these terms.

5. User-generated content

"User content" means anything you post, upload or share through the App — including videos, images, event details, profile information and in-game activity.

  • You keep ownership of your user content.
  • You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt (for example, transcode video for streaming), display and distribute your user content for the purpose of operating and promoting the App. This licence lasts while your content is on the App and for a reasonable period afterwards to allow for backups and removal.
  • You're responsible for your user content and confirm you have the rights to share it and that it doesn't break these terms, our Community Guidelines, or anyone else's rights.
  • We don't pre-screen content, but we may remove or restrict content that breaches these terms. See the Content and Copyright Policy for how to report content and make copyright complaints.

6. Venue accounts

  • Venue accounts are for licensed or legitimate hospitality businesses. Venues can manage a profile, post events and Reels, and add ticket links.
  • Venues must follow the Venue Partner Terms in addition to these terms.
  • Venue content must be accurate and not misleading — including event times, promotions, entry conditions and ticketing. We may remove venue content or suspend a venue account that breaches these terms.

7. Events, promotions and tickets

  • Events, promotions and offers shown in the App are created and controlled by venues, not by us. We don't guarantee they are accurate, available, or that an event will go ahead.
  • Ticket links point to third-party websites. We don't sell tickets, process ticket payments, or handle refunds. Any purchase is a transaction between you and the venue or its ticketing provider, governed by their terms.
  • Always check details directly with the venue before relying on them.

8. Games and social features

  • The App includes social games (for example Truth or Dare, King's Cup, Buzz'n, Pub Golf, and the real-world game Chicken Run). These are for entertainment among friends.
  • Some games encourage real-world activity and movement between venues. You take part at your own risk and are responsible for your own safety and for drinking responsibly. See the Safety Policy.
  • You must not use any game to harass, endanger, trespass, or break any venue's rules or the law.

9. Payments and subscriptions

Out'n'About is currently free to use and does not charge for accounts, features or content. There are no in-app purchases or subscriptions. If we introduce paid features in future, we'll set out the terms and pricing clearly before you're charged.

10. Third-party services

The App relies on third-party services to work, including Google (Firebase authentication and messaging, Google Maps, Google Cloud Storage), Apple (Sign in with Apple), and Google/Apple sign-in. Ticket links, maps directions and social logins may take you to third-party services governed by their own terms and privacy policies. We're not responsible for third-party services, but we choose them carefully — see the Privacy Policy for how data is shared with them.

11. Intellectual property

  • The App itself — its software, design, branding, name, logo and the "Out'n'About" identity — belongs to us or our licensors. You may not copy, modify, distribute or create derivative works from it except as allowed by law.
  • We grant you a limited, personal, non-transferable, revocable licence to use the App for its intended purpose while you comply with these terms.
  • Nothing in these terms transfers our intellectual property to you, or your user content to us beyond the licence in section 5.

12. Suspension and termination

  • You can stop using the App and delete your account at any time.
  • We may suspend or terminate your account, or remove content, if you breach these terms, our Community Guidelines, or the law, or if we reasonably need to protect other users, venues, or the App. Where practical and lawful we'll give you notice and a chance to respond.
  • Some things naturally survive termination, including content licences needed for backups, intellectual property rights, disclaimers, and limitations of liability.

13. Disclaimers

  • The App is provided "as is" and "as available". We don't promise it will always be available, uninterrupted, error-free, or that content (including venue, event and crowd information) is accurate or complete.
  • Venue listings, opening hours, events, promotions, crowd indicators and location information may be out of date or wrong. Always confirm important details directly with the venue.
  • Nothing in these terms excludes rights you have under the Australian Consumer Law that can't legally be excluded. Where we're allowed to limit liability, our liability for the supply of services is limited to re-supplying them or paying the cost of having them re-supplied.

14. Liability

To the extent permitted by law:

  • We're not liable for indirect, incidental or consequential loss, or for loss of data, profits, or opportunity, arising from your use of the App.
  • We're not responsible for the conduct of other users, venues, or third parties — including anything that happens when you meet people, attend venues, or take part in real-world games. Please read the Safety Policy.
  • Our total liability to you for any claim connected with the App is limited to the amount you paid us to use it in the 12 months before the claim (which, while the App is free, is nil), except where the law requires otherwise.

15. Indemnity

You agree to reasonably indemnify us against claims, losses and costs arising from your breach of these terms, your user content, or your misuse of the App, except to the extent the loss was caused by us.

16. Governing law

These terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia.
